The Bureau of Internal Revenue has finally issued the Implementing Rules and Regulations (IRR) to Republic Act (RA) 9504. This is Revenue Regulations No. 10-2008 dated July 8, 2008.
The pro-rated application of the personal and additional exemptions in this IRR runs contrary to a previous Supreme Court ruling on Umali v. Estanislao promulgated last May 29, 1992. In this case, the Supreme Court ruled that RA 7167, increasing the personal and additional tax exemptions of individual taxpayers, was applicable to income earned for the entire year of 1991, even though this law took effect on January 30, 1992. This is the contention of some senators and labor groups who assail this revenue regulation.
As always, we have to wait how the Supreme Court will rule on this.
